الحق في الدفاع كمعيار للمحاكمة العادلة أمام المحاكم الجنائية الدولية والمختلطة

الملخص
كرست المحاكم الجنائية الدولية والمختلطة معايير وضمانات المحاكمة العادلة الواردة في القانون الدولي لحقوق الإنسان، ومن ضمنها تلك المرتبطة بالحق في الدفاع. حيث تضمنت القوانين المنظمة لعمل هذه المحاكم بما فيها أنظمتها الأساسية، وقواعدها الإجرائية، مجموعة من الأحكام القانونية المتعلقة بهذا الحق والواجب مراعاتها خلال كافة مراحل المحاكمة. بهدف احترام وضمان حق المشتبه به أو المتهم في الدفاع عن نفسه بشكل كاف وفعال. كما تطرقت المحاكم الجنائية الدولية والمختلطة في أحكامها إلى مختلف جوانب الحق في الدفاع التي كانت محلا للاحتجاج والجدال خلال سير المحاكمات، مقدمة العديد من الاستنتاجات والتفسيرات التي خلصت إليها في هذا السياق. ومع ذلك فقد واجهت فرق الدفاع مجموعة من العقبات والتحديات التي أعاقت أداء عملها، مما أثّر أحيانا على عدالة الإجراءات أمام هذه المحاكم، وعرقل الاستيفاء الكامل لمتطلبات الحق في الدفاع. International and hybrid criminal courts and tribunals have enshrined the standards and guarantees of a fair trial set out in international human rights law, including those related to the right to defence. The laws governing the work of these tribunals, including their statutes and procedural rules, contain a set of legal provisions related to this right, which must be observed during all stages of the trial, with the aim of respecting and ensuring the right of the suspect or accused to adequately and effectively defend themselves. In their judgments, international and hybrid criminal tribunals have addressed various aspects of the right to defence that were subject to dispute and controversy during the course of the trials, offering numerous conclusions in this context. However, defence teams have faced a number of obstacles that have hampered their work, which sometimes affected the fairness of the proceedings before these tribunals and hindered the full fulfilment of the requirements of the right to defence.
