الروبوتات العسكرية الذكية: دراسة من منظور القانون الدولي الإنساني

الملخص
يدخل الروبوت العسكري ضمن مستحدثات الأسلحة المستقبلية، في اتخاذ البديل الآلي للإنسان ليتولى إدارة وتنفيذ العمليات العسكرية ضمن نطاق النزاعات المسلحة. ولما كانت هذه الأخيرة مؤطرة ضمن قواعد دولية، ذات طابع حمائي، بمسمى: "قواعد القانون الدولي الإنساني"، والتي يترتب عن انتهاكها قيام المسؤولية الدولية، فإنه من الضروري أن يخضع الروبوت لهذا القانون، ويتم تقييد استعماله وفقا لأعراف ومبادئ الحرب؛ الأمر الذي يطرح إشكالات عدة مرتبطة بداية بخصوصية القانون الدولي الإنساني، المبني على الأخلاق الإنسانية، التي تميز بني البشر عن الآلة، والتي تعد الشرط الحتمي لاستخدام الروبوت العسكري الذكي، ليتجلى بذلك صعوبة امتثالها لقواعد هذا القانون، وضرورة إيجاد أنظمة قانونية من شأنها الاستجابة لخصوصيات الروبوت العسكري، وأن تتلاءم مع مقتضيات قواعد القانون الدولي الإنساني، التي تشكل مبادئ أساسية لا يمكن تجاوزها. The smart military robot falls within the novelties of the future combat weapons achieved by the human genius as an automated alternative to human, to manage and conduct the military operations within the scope of the armed conflicts, and since the latter is framed within the protective international legal rules known as: "the Rules of the International Humanitarian Law", and the breach of which results the international responsibility; it is essential to subject the military robot to these rules in order to prevent the damages it may entail, and restrict its use in accordance with the norms and the principles of this law. This raises several problems, starting with the particular nature of the international humanitarian law based on the human ethics that distinguish the human being from machines and considered as an imperative condition to use the smart military robot.
