حماية العون الاقتصادي من الممارسات التجارية غير النزيهة

الملخص
الملخص: يتناول هذا المقال حماية العون الاقتصادي من الممارسات التجارية غير النزيهة في ظل التشريع الجزائري، من خلال إبراز التوازن بين حرية المنافسة وضرورة تقييدها بضوابط قانونية تضمن نزاهة المعاملات واستقرار السوق. وقد عرّفت هذه الممارسات باعتبارها كل سلوك مخالف للأعراف التجارية يضر بمصالح الأعوان الاقتصاديين، مع تصنيفها إلى ممارسات تهدف إلى إضعاف المنافس وأخرى ترمي إلى الاستفادة غير المشروعة من تفوقه، وتقتضي حماية العون الاقتصادي من هذه الممارسات وجود منظومة متكاملة من الآليات الإدارية والقضائية؛ حيث تعتمد الإدارة على أجهزة رقابية مركزية ومحلية تمارس صلاحيات التحقيق واتخاذ التدابير الوقائية والزجرية، بينما يضطلع القضاء الجزائي بدور ردعي، ويوفر القضاء المدني والتجاري الحماية عبر الإبطال والتعويض، في حين يضمن القضاء الإداري مشروعية القرارات الإدارية، وعليه؛ فإن فعالية هذه الحماية تبقى رهينة بتكامل هذه الآليات وتفعيلها بشكل منسق بما يحقق التوازن بين حرية المبادرة الاقتصادية وحماية المنافسة المشروعة. Abstract: This article analyzes the protection of the economic operator from unfair commercial practices under Algerian law, emphasizing the balance between freedom of competition and its legal regulation to ensure fair transactions and market stability. It defines such practices as conduct contrary to honest commercial standards that harms competitors, classifying them into acts that weaken competitors and those that exploit their advantage. The study highlights that effective protection requires an integrated system of administrative and judicial mechanisms. Administratively, central and local authorities exercise oversight through investigation and preventive and punitive measures. Judicially, criminal courts ensure deterrence, while civil and commercial courts provide remedies through annulment and compensation. Administrative courts safeguard legality by reviewing administrative decisions. Ultimately, the effectiveness of this protection depends on the coordinated functioning of these mechanisms to maintain fair competition and economic freedom
