Demonstration is a means for individuals to express their opinions on political, economic, or social issues within society. It is often resorted to when the activities of public authorities' conflict with the desires and rights of individuals, or when there is an infringement on a fundamental right, or to change an existing regime that does not uphold their rights and interests. This method becomes active to express rejection and non-acceptance of the policies adopted by the current ruling system. Often, carrying out these demonstrations—whether organized or, at times, unorganized—results in severe damages manifested in the destabilization of security and stability, and assaults on both public and private property within the community. In light of this dangerous reality of demonstrations, it was necessary to study the issue of demonstration from both legal and religious perspectives. This study, titled: "Criminal Responsibility of Demonstrators: A Comparative Study between Islamic Jurisprudence and Positive Law," aims to clarify the legal and religious rulings regarding the occurrence of demonstrations and to outline the criminal responsibility of demonstrators in both Islamic jurisprudence and positive law. This study concluded that: Demonstration in Islamic jurisprudence has neither a prohibition nor permissibility evidence. Through reviewing the evidence presented on this issue, it became clear that it is permissible, provided it is within certain controls, as it is one of the most important means of expressing opinions or demanding rights in our current era, given the state's often unresponsive behavior to its citizens' demands. Demonstration is permissible in positive legislations, as evidenced by international treaties and covenants, as well as constitutional and ordinary legal texts, but it must be within specific legal controls. As for criminal responsibility, it exists for demonstrators regarding their acts of aggression against the rights of others, when they can be identified and held criminally accountable in a legitimate and legal manner. A person who commits intentional murder is subject to retribution according to the rules and provisions of Islamic law, and is executed according to the provisions of positive criminal laws, and so on. Moreover, demonstration is not considered a mitigating factor for punishment that demonstrators can benefit from; on the contrary, it is a circumstance that aggravates the situation, considering the conditions under which the crime is committed in an atmosphere of insecurity and instability, exploiting that situation which facilitates the commission of the crime.
