آليات تعزيز اللامركزية الإدارية للجماعات المحلية في الجزائر لبناء نموذج حوكمة تنموية

الملخص
يهدف المقال إلى اقتراح حلول كفيلة بتفعيل اللامركزية الإدارية في الجزائر، من خلال تقصي آليات الانتقال من الإدارة التقليدية إلى نموذج حوكمة تنموية شاملة، بالاعتماد على تحليل مضمون القوانين المنظمة للجماعات المحلية في الجزائر الدستور وقانوني البلدية والولاية، وتنبثق إشكالية البحث من التناقض بين النصوص القانونية المكرسة للامركزية الإدارية، وواقع هيمنة السلطة الوصائية، مما أثر سلبا على الفعالية التنموية للجماعات الإقليمية، وقد توصلت الدراسة إلى ضرورة إلغاء الوصاية والمصادقة القبلية والتحول إلى الرقابة البعدية، وتقديم مساعدات غير مشروطة من الدولة للجماعات المحلية لدعم استقلالها المالي، وتوسيع صلاحياتها لتطوير مواردها الذاتية، بالإضافة إلى ضرورة مراجعة الأنظمة الانتخابية بما يضمن كفاءة المنتخبين المحليين، وتخلص الدراسة الى أن نجاح مسار التنمية المحلية بكفاءة وفعالية يتطلب الاعتماد على الرقمنة الشاملة وإرساء المقاربة التشاركية والمساءلة الشعبية. Abstract: This article aims to propose effective solutions for activating administrative decentralization in Algeria by investigating the mechanisms of transitioning from traditional administration to a model of comprehensive developmental governance, based on a content analysis of the laws regulating local communities in Algeria, namely the Constitution and the municipal and wilaya codes. The research problem stems from the contradiction between the legal texts enshrining administrative decentralization and the reality of the tutelary authority's dominance, which has negatively affected the developmental efficiency of regional communities. The study concludes that it is necessary to abolish tutelage and prior approval and transition to post-audit control, and for the state to provide unconditional assistance to local communities to support their financial independence and expand their powers to develop their own resources. In addition, it emphasizes the need to revise electoral systems to ensure the competence of elected local officials. The study concludes that the success of the local development process with efficiency and effectiveness requires reliance on comprehensive digitization and the establishment of a participatory approach and popular accountability.
