Abstract

Civil liability is one of the most important topics addressed by the Civil Code in all legislation. However, this liability has become a difficult crisis, perhaps due to the shortcomings and stagnation that have become apparent in its pillars and its inability to achieve the functions assigned to it, which has pushed it to retreat, which has prompted modern legislation to cling to the insurance system and search for new mechanisms for compensation Perhaps the reason for the crisis that civil liability is suffering from is due to the clash of the pillars of civil liability and its traditional foundations with modern developments, which has made traditional liability unable to absorb modern and diverse dangers, which has created a real crisis that is ravaging liability. تعد المسؤولية المدنية من أهم المواضيع التي عالجها القانون المدني في التشريعات قاطبة، إلا أن هذه المسؤولية أصبحت تشهد أزمة عصيبة و لعل ذلك راجع للقصور و الجمود الذي أصبح ظاهرا في أركانها وعدم قدرتها على تحقيق الوظائف المسندة إليها مما دفع بها إلى التراجع مما دفع بالتشريعات الحديثة إلى التشبث بنظام التأمين و البحث عن أليات جديدة للتعويض، و لعل سبب الأزمة التي تعاني منها المسؤولية المدنية راجع إلى إصطدام أركان المسؤولية المدنية و أسسها التقليدية بالتطورات الحديثة مما جعل من المسؤولية التقليدية غير قادرة على إستيعاب الأخطار الحديثة و المتنوعة مما خلق أزمة حقيقية تعصف بالمسؤولية.
