دور الاجتهاد القضائي الجزائي في ضمان الأمن القانوني

الملخص
تحتوي المنظومة التشريعية الجزائرية في مجال القانون الجزائي نجدها تحتوي على مجموعة من النصوص القانونية المتعددة سواء في ميدان التجريم و العقاب أو في الجانب الإجرائي الجزائي ، وهنا يبرز دور السلطة التشريعية في صياغة نصوص قانونية أكثر ملائمة مع المتغيرات الحاصلة على مستوى المجتمع كظهور جرائم مستحدثة مثلا أو تغيُّر أسلوب ارتكاب الجرائم كدخول الوسائل التكنولوجية في ذلك، فالمشرع قد لا يصيب في تحديد جميع الأفعال المجرمة و هنا نكون أمام قصور تشريعي في غياب نص قانوني لواقعة تُشكل إضرار بالفرد أو المجتمع ، هذا ما يتطلب مسألة تدارك هذا الوضع ونفس الحالة تنطبق في حالة عدم فعالية الجزاء الجنائي أي عدم تحقيق الجزاء الجنائي للردع العام في جريمة ما ، هنا يبرز دوره أيضا في عملية الاجتهاد القضائي هذه الأخيرة الّتي يكون لها صدى في ضمان أمن قانوني. The Algerian legislative system in the field of criminal law contains a set of multiple legal texts, whether in the field of criminalization and punishment or in the criminal procedural aspect. Here, the role of the legislative authority in drafting legal texts that are more appropriate with the changes taking place at the level of society, such as the emergence of new crimes, for example, or the change in the method of committing crimes, such as the entry of technological means into it. The legislator may not be able to identify all criminal acts, and here we are facing a legislative deficiency in the absence of a legal text for an incident that constitutes harm to the individual or society. This is what requires the issue of remedying this situation and the same situation applies in the case of the ineffectiveness of the criminal penalty, that is, the failure to achieve the criminal penalty for general deterrence in a crime. Here, its role also emerges in the process of judicial jurisprudence, the latter, which has a resonance in ensuring legal security.
