الملخص. يتناول هذا البحث المركز القانوني للاجئ البيئي في القانون الدولي مسلطًا الضوء على تطور مفهوم النزوح البيئي وتعدد دلالاته والتمييز بين اللاجئ البيئي والمصطلحات المشابهة مثل النازح والمهاجر، كما يدرس البحث الثغرات القانونية في حماية اللاجئين البيئيين على المستوى الدولي والإقليمي، ومبررات توفير الحماية القانونية لهم انطلاقًا من حقوق الإنسان والحق في بيئة سليمة، ويخلص البحث إلى أهمية إرساء إطار قانوني متكامل يشمل صياغة اتفاقية دولية خاصة وتعزيز حماية النازحين داخليًا، وضمان الحقوق الإنسانية والبيئية مع اعتماد آليات للتكيف ومواجهة الكوارث البيئية. الكلمات المفتاحية: اللاجئ البيئي، النزوح القسري، القانون الدولي، الكوارث الطبيعية، التغير المناخي، الحماية القانونية، النازح الداخلي، الاتفاقيات الدولية، حقوق الإنسان، التنمية المستدامة Abstract This study addresses the legal status of the environmental refugee in international law, highlighting the evolution of the concept of environmental displacement and its multiple interpretations, as well as distinguishing the environmental refugee from similar terms such as internally displaced persons and migrants. The study also examines the legal gaps in the protection of environmental refugees at both international and regional levels, and the justifications for providing them with legal protection, based on human rights and the right to a healthy environment. The research concludes on the importance of establishing a comprehensive legal framework, including drafting a dedicated international convention, strengthening the protection of internally displaced persons, ensuring human and environmental rights, and adopting mechanisms for adaptation and disaster management.
