Abstract

In this study, we addressed the nature of the claim of the debtor's disposition being unenforceable against their creditors, its basis, and its nature in the first section; then we moved on to explain the conditions of the claim of the debtor's disposition being unenforceable against their creditors. In the second section, we discussed the requirement that the creditor's right must be due for performance, distinguishing between the conditions of the claim that relate to the contested disposition and the conditions that relate to the debtor, where the debtor's disposition must cause or increase their insolvency and be characterized by fraud. In the third section, we addressed the effects of the claim of the debtor's disposition being unenforceable against their creditors while the disposition remains valid between the contracting parties; and we concluded the study with an explanation of the inadmissibility of the claim of the debtor's disposition being unenforceable against their creditors. I have reached a set of conclusions, the most important of which is that the principle 'fraud corrupts everything' holds a prominent place in Islamic jurisprudence, the Saudi civil transactions system, and the Egyptian Civil Code. It is not sufficient to file a lawsuit to invalidate the debtor's transactions against his creditors merely because the contested transaction caused or increased the debtor's insolvency, unless it was made by the debtor with fraud. Here, good or bad faith has the greatest effect on whether the transaction is effective against the creditor or not. The claim to invalidate the debtor's transactions against his creditors is of a purely personal nature, as it applies to all cases in which the debtor deceives his creditors. The burden of proving fraud, deception, or trickery lies on the claimant according to the general rules of evidence, and the occurrence of facts constituting fraud is an objective matter subject to the assessment of the trial judge. The judgment to invalidate the debtor's transactions in favor of the creditors does not affect the validity of the transaction between the debtor and others, so it remains valid as long as it meets its essential requirements.
