This study analyzes the legal guarantee framework of the Algerian Investment Law No. 22-18 and its effectiveness in establishing "legal security" for attracting Foreign Direct Investment (FDI). The research examines the shift in Algerian legislative doctrine from "protective closure" (51/49 ownership rule) to "calculated openness," with restrictions limited to strategic sectors. The study emphasizes Article 23, which enshrines the legislative stabilization clause protecting investors' acquired rights from future fiscal and regulatory changes. It examines dispute resolution mechanisms, including the "High National Commission for Appeals" and the right to international arbitration under Bilateral Investment Treaties (BITs). The study concludes that the new legal framework aligns with international standards. However, its effectiveness depends on practical implementation by the administrative judiciary and modernization of the judicial system to match evolving international business dynamics.
