Abstract: (Do not exceed 150 words) This research examines the legal impact of Royal Decree No. (35/2022) on the structure of the judicial system in the Sultanate of Oman, through an analysis of the implications of transferring administrative circuits into the ordinary judiciary system on the concept of jurisdictional competence and the limits of its continuity. The study proceeds from a central question: Does jurisdictional competence continue to exist after the abolition of institutional dualism within the judiciary, or has it transformed into a different form of competence within a unified judicial authority? The research aims to establish the doctrinal foundations of jurisdictional competence in Omani legislation, clarify its criteria before and after the transfer, and assess the adequacy of the current legislative and judicial framework in regulating the distribution of the judicial function, particularly in administrative disputes. Methodologically, the study adopts a foundational and analytical approach based on the analysis of constitutional and legislative texts governing judicial competence, foremost among them the Basic Law of the State, the Judicial Authority Law, the Civil and Commercial Procedures Law, and the Administrative Procedures Law, in addition to surveying judicial applications issued both before and after Royal Decree No. (35/2022). The study reaches a principal conclusion that jurisdictional competence—being a form of competence premised on the existence of multiple independent judicial bodies—can no longer be conceived in its traditional sense following the transfer of administrative judiciary. This has affected two matters that had previously been settled in Omani jurisprudence prior to the amendment: first, the acquisition of res judicata authority by judgments; and second, the obligation of the court or circuit to which a case is referred to adjudicate the merits. The study further finds that the appellate circuit’s decision to maintain the competence of the administrative circuits, and to refrain from adjudicating the dispute after its referral from the ordinary judiciary on grounds of lack of jurisdiction, does not accord with correct legal principles. The study also reveals a regulatory vacuum resulting from the abolition of the Tribunal of the Conflict of Jurisdiction and Judgments, and the practical challenges that may arise in cases of conflicting judgments within a unified judicial authority. Accordingly, the study recommends, in particular, comprehensive legislative intervention to amend the Judicial Authority Law—especially Article (8)—as well as Articles (36), (110), and (112) of the Civil and Commercial Procedures Law, in a manner that aligns with the legislator’s intent following the merger, reduces divergence in judicial interpretations concerning the determination of competence among circuits, and clearly defines the legal effects arising therefrom.
