الملخص

ملخص: تتناول هذه الدراسة أثر مقاصد الشريعة في معايرة الخلافات المذهبية؛ باعتبارها (أي الخلافات) مَسلكا أعمله الفقهاء والأصوليون في إيراد الأقوال والاستدلالات، لذا ينبغي استثمار علم المقاصد لرفع الخصومات أو التقليل منها، وفي تقرير الأحكام وتقصيد النوازل، إما بالجمع بين الأقوال أو الترجيح بينها إذا وُجدت المسوغات، وذلك من خلال ربط الأحكام بحِكَمها وعللها ومآخذها الكلية التي يتشوّف إليها التشريع، مع تهذيب مناهج النقد والخلاف في بوتقة مقاصد الشريعة؛ باعتبارها وعاءً جامعًا يحفظ النّص، ويحقق المصلحة، ويخفف من حدّة التعصب المذهبي... وذلك باستثمار علم المقاصد في رفع الخلاف ومحاكمة النوازل في واقع النّاس.. Abstract : This study addresses the impact of the higher objectives of Islamic law (Maqāṣid al-Sharīʿah) in evaluating and managing doctrinal differences among Islamic schools of thought. These differences are regarded as a scholarly approach adopted by jurists and legal theorists in presenting various opinions and arguments. Therefore, the science of Maqāṣid should be utilized to reduce or resolve disagreement, and to guide the formulation of legal rulings and the interpretation of contemporary issues. This can be achieved either by reconciling differing views or by favoring one opinion over others when valid grounds exist. The approach involves linking rulings to their underlying wisdom, effective causes, and the general objectives that Islamic legislation seeks to realize. Furthermore, it calls for refining methods of critique and disagreement within the framework of Maqāṣid al-Sharīʿah, as it represents a comprehensive paradigm that preserves the texts, serves the public interest, and mitigates sectarian partisanship—by applying the science of Maqāṣid in resolving disagreement and addressing new emerging issues in people's daily lives.
