Guarantees Of A Fair Trial And The Right To Defense Under The Penal Order System.

Abstract

The issue of immediate trial is among the most important topics that have been addressed, both internationally, through the International Covenant on Civil and Political Rights, and nationally, through the 2020 Constitution and the Code of Criminal Procedure. This is due to several reasons, including the need for speed in various transactions, including those related to the judiciary, and the requirements of rights themselves, especially the right to a fair trial through respect for the presumption of innocence and the right to defence. الملخص : تُعدّ مسألة المحاكمة الفورية من أهم المواضيع التي تمّ تناولها، دولياً من خلال العهد الدولي الخاص بالحقوق المدنية والسياسية، ووطنياً من خلال دستور عام 2020 وقانون الإجراءات الجنائية. ويعود ذلك إلى عدة أسباب، منها الحاجة إلى سرعة البتّ في مختلف المعاملات، بما فيها تلك المتعلقة بالقضاء، ومتطلبات الحقوق نفسها، ولا سيما الحق في محاكمة عادلة من خلال احترام قرينة البراءة والحق في الدفاع.
