نحو إطار قانوني للذكاء الاصطناعي

الملخص
الملخص: تهدف هذه الدراسة إلى محاولة استقصاء كيفية تنظيم الجوانب القانونية ، لأنظمة الذكاء الاصطناعي ، و كيفية إمكانية صياغة قواعد قانونية للذكاء الاصطناعي بناء على مبادئ خاصة ، فهذه الدراسة تقوم على شقين الأول يحاول التعرف على مفهوم الذكاء الاصطناعي و الأنظمة التي يمكن تطبيقها من الناحية القانونية بعيدا عن الجانب العلمي التكنولوجي كفاعل تصدر عنه تصرفات قانونية ، كما تقدم هذه الدراسة من جانب أخر ما يترتب عن هذه التصرفات من مسؤوليات قانونية من جوانب عدة إدارية ، مدنية ، جنائية و ما مدى المسؤولية التي يتحملها كل طرف من المصنع ، المورد ، المستعمل ..... و منه تهدف إلى إلقاء الضوء على العلاقة بين التشريع والذكاء الاصطناعي ، من خلال منح إطار أخلاقي تشريعي و تنظيمي ، لاستخدامات أنظمة الذكاء الصناعي ، على اعتبار انه لا تزال المؤسسات الدستورية السياسية و الإدارية تواجه صعوبة في فهم و التكيف مع هذه التقنيات الحديثة من جوانبها القانونية . Abstract: This study aims to investigate how to regulate the legal aspects of artificial intelligence systems and how to formulate AI legal rules based on specific principles. The study is structured in two parts: first, it attempts to define the concept of artificial intelligence and the systems that can be legally applied, separate from the scientific and technological aspect as an actor producing legally binding actions; and second, it presents the legal responsibilities arising from these actions in several aspects—administrative, civil, and criminal—and the extent of responsibility borne by each party, including the manufacturer, supplier, and user. It aims to shed light on the relationship between legislation and artificial intelligence, by providing an ethical, legislative and regulatory framework for the uses of artificial intelligence systems, given that constitutional, political and administrative institutions still face difficulty in understanding and adapting to these modern technologies from their legal aspects
