The Settlement Fine In Consumer Protection And Anti-fraud Law: Balancing Enforcement And Legal Certainty For Economic Operators (law No. 09-03, As Amended)

Authors : Djellakh Nassima .

Abstract

This paper explores the settlement fine as an innovative legislative mechanism introduced in the amended and supplemented Consumer Protection and Fraud Suppression Law No. 09-03. By enabling more robust safeguards for consumers against commercial fraud perpetrated by economic operators, it simultaneously offers a pathway for these operators to avoid judicial prosecution when non-compliance arises. Under this framework, fraud repression officers are empowered to impose settlement fines for specific offenses that endanger consumer health and safety, particularly fraud-related acts punishable by pecuniary sanctions. Nonetheless, the legislator has deliberately excluded from this scope a range of more serious infractions—especially those subject to custodial sentences.
