In light of changing economic and social conditions, the rapid increase in the number of retirees, and the inability of the National Pension Fund to disburse pensions and allowances that ensure a secure income, the legislator amended Law No. 83-12 on retirement through Law No. 16-15, with the aim of adopting measures to restore the Fund’s balance. This amendment maintained only ordinary retirement, abolished both proportional retirement and retirement without age condition, and suspended early retirement. Consequently, the scope of the right to retirement was narrowed, restricted, and workers were deprived of their annulled rights. However, in 2025 the legislator rectified the matter and introduced the right to reduced-age retirement in the field of education by enacting Law No. 25-09, which applies to teaching staff under new conditions. Despite this, the right to retirement remains restricted and limited in scope due to the predominance of economic considerations over social ones. The retirement system lacks flexibility, and the worker ultimately bears the consequences of being deprived of the benefits of his annulled and suspended rights.
Right to retirement; Pension; Reduced-age retirement; Proportional retirement; Early retirement.
