Regulatory Controls Of Media Freedom Within The Framework Of Judicial Investigation

Authors : Kouadri Samet Djawhar .

Abstract

Media activity is founded on the principle of publicity; therefore it may conflict with other domains that require confidentiality, foremost among them the judicial investigation, which is characterized by secrecy as affirmed by Article 19 of the Algerian Code of Criminal Procedure in its first paragraph, and likewise confirmed by Article 3 of Algerian Media Law No. 23-14, which is embodied through the obligation to keep investigation secrets and not to publish them without permission. Breaching these controls inevitably leads to the commission of unlawful acts, legally described as crimes of prohibited publication, because of the resulting impairment to the course of justice, the judiciary, and the positions of litigants.
