The legal framework for protecting the environment during armed conflicts is based on the 1977 Additional Protocol I, which prohibits widespread, long-term and severe damage to the environment, and the 1976 ENMOD Convention, which prohibits the use of environmental modification techniques for military purposes. Protection also extends to civilian environmental objects such as forests and rivers, based on the principles of distinction, proportionality and precaution, which require parties to a conflict to avoid damaging the natural environment and to take possible measures to limit negative effects on the environment. These principles are considered fundamental pillars of international humanitarian law to ensure the protection of the environment during conflicts. However, the practical application of these rules remains limited due to their inadequacy and ambiguity, weak accountability mechanisms and the difficulty of proving violations, particularly in light of the complexity of modern armed conflicts and the overlap between military and civilian targets, which hinders the implementation of relevant legal obligations. Furthermore, the absence of precise definitions of terms used in legal texts, such as ‘extensive,’ “prolonged” and ‘severe,’ leads to differences in interpretation and weakens the effectiveness of protection, highlighting the need to develop these rules and strengthen monitoring and accountability mechanisms
