.technical Protection Of Digital Intellectual Works

Abstract
تعتبر التدابير التكنولوجية آلية حمائية يمكن للمؤلف من خلالها السيطرة على مصنفه الرقمي وحمايته من جريمة القرصنة الالكترونية، من هذا المنطلق نطرح الإشكالية التالية: ما مدى فعالية الآليات التقنية في تقرير حماية فعالة للمصنف الفكري الرقمي ضد جريمة القرصنة؟. للتحقيق الأهداف المبتغاة من خلال البحث كان لابد من الاعتماد على مناهج معينة في هذه الدراسة حيثاعتمدنا على المنهج الوصفي التحليلي الذي ساهم في تقديم حلول ملائمة لمشكلة محل بحث ودراسة. من أهم المقترحات التي خرجنا بها في عذه الدراسة هو التعجيل بتشديد العقوبات الردعية الصارمة ضد مرتكبي جريمة القرصنة خاصة وأنها كثيرة الانتشار، مع تطوير جميع الآليات للحد منها، و كذا العمل على سن تنظيم قانوني عالمي لمكافحة القرصنة بالتعاون مع المجتمع الدولي بهدف جعله كمرجع للدول التي ترغب بإصدار قانون لمكافحة القرصنة على شبكة الأنترنت. Abstract: Digital piracy protection fundamentally relies on technological measures that enable authors to control and safeguard their digital works. This study examines the effectiveness of such technical mechanisms in ensuring adequate protection against piracy. Adopting a descriptive-analytical approach, the research methodically explores solutions to the problem and poses the central question: to what extent do these measures effectively secure intellectual digital creations? Key proposals from the study include the rapid imposition of strict, deterrent penalties on piracy offenders, the enhancement of existing mitigation mechanisms, and the development of a global legal framework. Such a framework, forged in cooperation with the international community, is envisioned to serve as a benchmark for countries seeking to implement anti-piracy legislation. Overall, the study underscores the critical role of combining advanced technological measures with robust legal strategies to combat digital piracy effectively.
