-الخطأ اللغوي و علاقته بالخطأ في التكييف القانوني-مقاربة دلالية

الملخص
االلغة هي الوعاء الحامل للقانون، كونها تمدّ المعجم القانوني بالمصطلاحات والمفاهيم لتأدية المعنى المراد. فسلامة اللغة ووضوحها مناط فهم النص القانوني فهما صحيحا. و لا يتأتى هذا المقصد إلا بامتلاك رجل القانون ناصية اللغة وما تحتمله من تأويلات وفهم . وعليه، نروم من خلال هذه الورقة البحثية رصد الأخطاء المعجمية و الدلالية، التي يقع فيها القاضي الجنائي، أثناء صياغته للأحكام القضائية بمناسبة فصله في النزاعات المعروضة عليه، التي يترتب عليها خطأً في التكييف القانوني للوقائع الجنائية، المؤدي إلى الخطأ في تطبيق القانون، باعتبار التكييف القانوني عمل قضائي يعكس التقاطع المعرفي بين اللغة والقانون،و بوصفه إنجازا لغويا يتم من خلاله نقل الوقائع من حيّزها الواقعي المادي إلى الحيّز اللغوي الإنجازي، حيث يطابق فيه القاضي بين الوقائع المعروضة عليه والقاعدة القانونية واجبة التطبيق للوصول إلى الحكم الصحيح، و يرجع الخطأ في التكييف الجنائي، لعدة أسباب منها ما هو لغوي، ومنها ما يرجع لاعتبارات غير لغوية, حيث سنتناول في هذه الورقة البحثية على الأسباب اللغوية، المتعلقة أساسا بالأخطاء الدلالية و المعجمية ذات صلة بسوء توظيف المصطلحات القانونية و اللغوية من قبل القضاة، المؤدية إلى استدراك الأحكام القضائية عن طريق تصحيحها أو تفسيرها،أو استئنافها أمام المجالس القضائية، أو نقضها أمام المحكمة العليا وفق التنظيم المعمول به، مما يؤثر سلبا على مصالح المتقاضين و حسن سير مرفق القضاء Language is the vessel through which the law is conveyed, as it embodies legal concepts through words and legal terminology to communicate intended meanings. Therefore, linguistic accuracy and clarity are essential for correctly understanding legal texts. This objective can only be achieved through the legal professionals command of language and their ability to grasp its interpretation and nuanced meanings. therefore, through This research paper we seeks to identify and analyze semantic and lexical errors committed by the criminal judge, when formulating judicial rulings, especially in resolving disputes presented to them, this leads to an error in the legal classification of criminals facts, which in turn results in a misapplication of the law, considering that legal classification is a judicial act reflecting the cognitive intersection between language and law, As a linguistic accomplishment ,constitutes the process through which factual realities are transferred from their material and actual realm to the per formative linguistic expression. when the judge aligns the facts presented to him with the applicable legal rule, in order to reach a just and proper judgment. The legal misclassification is attributable to the both linguistic and non-linguistic causes. In this research paper, we shall address one aspect of the linguistic causes, especially those related to semantic and lexical errors, which is closely related to the improper use of linguistic and legal terms by judges, which often leads to the reconsideration of judicial decisions through their correction or interpretation, or to the appeal of judgment before judicial councils, or before the supreme court. which negatively affects litigants' rights and the proper functioning of the judiciary
