As the global tide turns toward renewable offshore energy, the face of territorial seas has been dramatically altered by the spread of energy installations, redrawing the balance between of coastal sovereignty and freedom of navigation. This change has raised unprecedented legal problems, making traditional notions such as “innocent passage” and “marine obstructions” inadequate to deal with the changing maritime reality. This work points out gaps in the 1982 United Nations Convention on the Law of the Sea (UNCLOS), specifically the vagueness surrounding the regulation of safety zones and the lack of harmonized standards for the interpretation of navigational harm. Based on an in-depth legal analysis, the work suggests revising Article 60 of UNCLOS and adopting an ancillary protocol to enhance transparency and regulate passage in installation-congested areas.
