اهتمام المذاهب الفقهية الإسلامية بفقه المقاصد الشرعية: المذهب المالكي أنموذجاً

الملخص
يحاول هذا البحث تبيان مركزية فقه المقاصد داخل المذهب المالكي، وذلك بواسطة الإجابة على الإشكالية الآتية: هل كان المذهب المالكي أسيراً للنقل والأثر، أم كان منفتحاً على العقل والنظر من خلال استحضار فقه المقاصد الشرعية عند الاجتهاد؟ ومن هذا المنطلق، فقد توخت هذه الدراسة كشف النقاب عن المنزلة الرفيعة التي يحتلها النظر عند علماء هذا المذهب الفقهي؛ وذلك من خلال رفع الحجاب عن المكانة الرفيعة التي يحتلها خطاب مقاصد الشريعة ضمن النسق الاجتهادي المالكي في أبواب العبادات والمعاملات. وقد تم إيضاح هذه المكانة اعتماد منهجين هما المنهج الاستقرائي المتعلق بتتبع واستقراء مختلف تجليات حضور فقه المقاصد عند المالكية على صعيد أصول المذهب (المصالح المرسلة، الاستحسان، سد الذرائع)، والمنهج التحليلي: إيضاح علاقة الاتساق والانسجام بين أحكام النوازل الفقهية وروح المقاصد عند السادة المالكية. كلمات مفاتيح: المذهب المالكي، مقاصد الشريعة، المصالح المرسلة، الاستحسان، سد الذرائع. Abstract: This research attempts to demonstrate the centrality of the jurisprudence of objectives within the Maliki school of thought, by answering the following problem: Was the Maliki school captive to transmission and tradition, or was it open to reason and contemplation by invoking the jurisprudence of the objectives of Islamic law when engaging in ijtihad? From this standpoint, this study aimed to unveil the high status that contemplation occupies among the scholars of this school of jurisprudence, by lifting the veil on the high status that the discourse of the objectives of Islamic law occupies within the Maliki ijtihad framework in the fields of worship and transactions. This position has been clarified by adopting two approaches: the inductive approach related to tracking and extrapolating the various manifestations of the presence of the jurisprudence of objectives among the Malikis at the level of the principles of the school (unrestricted interests, juristic preference, blocking the means), and the analytical approach: clarifying the relationship of consistency and harmony between the rulings of the jurisprudential issues and the spirit of objectives among the Maliki masters.
