Abstract ; The Algerian real estate market faces numerous challenges and difficulties due to the lack of laws regulating competition. Although Law 11-04 regulated the activity of real estate developers and defined their legal position as an intermediary and pivotal figure among those involved in real estate development, it did not restrict the relationship between real estate developers within the real estate market, creating a kind of competitive ferocity and restricting the principle of free competition. Furthermore, some real estate behaviors have emerged that are based on risk-taking in buying and selling based on price fluctuations rather than the law of supply and demand. Monopolies have also emerged in the market, which hurts the country's economic and social levels. To eliminate this phenomenon, the Algerian legislature had to intervene to control and regulate the real estate market by implementing the principle of free competition and strengthening its role in achieving balance and stability within it. This is the idea upon which this study was based. The research study concluded with some conclusions that demonstrate the importance of promoting the principle of free competition among real estate developers by addressing the rules of fair competition. We then addressed the implications of enshrining this principle in real estate developers' activities.
