الملخص
عقد الامتياز الفلاحي من الآليات القانونية الحديثة التي اعتمدها المشرع الجزائري لترقية واستصلاح الأراضي الفلاحية، في إطار استراتيجية تهدف إلى تحقيق الأمن الغذائي وتشجيع الاستثمار في المجال الزراعي، وقد نظم المرسوم التنفيذي رقم 21-432 كيفية منح هذا الامتياز لاستغلال الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، من خلال علاقة تعاقدية بين الدولة كمؤجر والمستثمر كمستفيد. يتيح العقد حق الاستغلال لمدة تصل إلى 40 سنة قابلة للتجديد، مقابل الالتزام بشروط الاستغلال الفعال، هذا العقد يشكل أداة إدارية ذات بعد اقتصادي واجتماعي تساهم في التنمية الفلاحية المستدامة. Abstract: The agricultural concession contract is one of the modern legal mechanisms adopted by the Algerian legislator for the promotion and development of agricultural lands, within a broader strategy aimed at achieving food security and encouraging investment in the agricultural sector. Executive Decree No. 21-432 regulates the procedures for granting such concessions for the exploitation of agricultural lands belonging to the private domain of the State, through a contractual relationship between the State as lessor and the investor as beneficiary. The contract grants the right of use for up to 40 years, renewable, in return for compliance with effective exploitation conditions. This contract constitutes an administrative instrument with both economic and social dimensions, contributing to sustainable agricultural development.
