The paper addresses the issue of the appeal of unconstitutionality mechanism, introduced by the Algerian constitutional amendment of 2016 and reaffirmed in the 2020 revision, as one of the posterior constitutional review methods. This mechanism aims to enable litigants, in general, to challenge legal provisions—whether legislative or regulatory—that may be contrary to the provisions of the Constitution, in order to guarantee their fundamental rights and freedoms. The article also highlights the stages of adopting the appeal of unconstitutionality mechanism within Algeria’s legal system, drawing inspiration from the French experience, as well as the conditions, mechanisms, and procedures that litigants must follow before the judicial bodies and the Constitutional Court.
