A fair trial is a fundamental principle of criminal law, ensuring the protection of the rights of those involved in legal proceedings and the legitimacy of the judicial system. This article traces its historical evolution, from Antiquity to contemporary international instruments (ECHR, ICCPR), and then examines its adaptation in Algerian law through the 2020 Constitution and the 2025 Code of Criminal Procedure. Recent reforms strengthen the rights of the defense, limit the duration of pretrial detention, create specialized courts, and promote the digitalization of procedures. The study emphasizes that the effectiveness of a fair trial depends on institutions, the training of legal professionals, and technological innovations, and that it constitutes a dynamic principle requiring continuous adaptation.
