الطّبيعة القانونية لعقد الامتياز الفلاحي في القانون الجزائريّ والمنازعات النّاشئة عنه

الملخص
ملخص: عقد الامتياز الفلاحي هو عقد إداري ذو طبيعة خاصة، جعله المشرّع الجزائري بموجب القانون رقم 10-03 آليّة حصريّة للاستثمار في الأراضي الفلاحية التابعة للأملاك الخاصة للدولة، فهو ينظم العلاقة بين الدولة باعتبارها مالك للأراضي الفلاحية والمستثمر صاحب الامتياز، يتميّز بالطابع التعاقدي والتنظيمي في آنٍ واحد، يمنح للمستفيد حق عيني عقاري مؤقت لاستغلال الأراضي الفلاحية. وبالنسبة للمنازعات التي تترتّب على عقد الامتياز الفلاحي، فهي حسب المعيار العضوي المكرّس من طرف المشرّع الجزائري في نص المادة 800 من قانون الإجراءات المدنية والإدارية، تدخل ضمن ولاية القضاء الإداري لكون الدولة أو إحدى الهيئات التابعة لها طرفًا في النزاع؛ إذ يفصل القضاء في مشروعية القرارات الإدارية المنفصلة عن عقد الامتياز الفلاحي عن طريق دعوى الإلغاء، كما يفصل في دعاوى التعويض المترتّبة عن العقد عند المساس بحقوق المستفيد. كلمات مفتاحية: عقد الامتياز الفلاحيّ. العقد الإداري. المستثمر. دعوى الإلغاء. دعوى التعويض. Abstract: The agricultural concession contract is an administrative contract of a special nature, instituted by the Algerian legislature under Law No. 10-03 as an exclusive mechanism for investment in agricultural land belonging to the State's private domain. It governs the relationship between the State, which owns the farmland, and the investor holding the concession, which is both contractual and regulatory in nature, granting the beneficiary a temporary right to use the farmland. As for disputes arising from the agricultural concession contract, according to the organic rule enshrined by the Algerian legislator in article 800 of the Code of Civil and Administrative Procedure, they fall within the jurisdiction of the administrative judge because the State or one of its bodies is a party to the dispute, with the judicial judge ruling on the legality of administrative decisions distinct from the agricultural concession contract by an action for annulment, and ruling on claims for compensation arising from the contract when the rights of the beneficiary are infringed.
