الملخص

ملخص: تعرض قطاع غزة الفلسطيني لعدة حروب متعاقبة، ارتكبت فيها مختلف جرائم الحرب، إلا أن الحرب الأخيرة (2023) تميزت بارتكاب جريمة الإبادة الجماعية في القطاع، إضافة لمختلف جرائم الحرب الموصوفة، وأظهرت المفارقة الواضحة بين استجابة القضاء الدولي متمثلا بمحكمة العدل الدولية والمحكمة الجنائية الدولية، وبين مجلس الأمن ودوره المعطل لوقف الحرب، الأمر الذي يبين أهم تداعيات هذه الحرب التي أظهرت القصور في نظام التصويت لدى مجلس الأمن الدولي والحاجة إلى إصلاحه. الكلمات المفتاحية: مجلس الأمن الدولي، المحكمة الجنائية الدولية، محكمة العدل الدولية، حرب غزة، جريمة الابادة الجماعية. Abstract: The Palestinian Gaza Strip has endured multiple successive wars, during which various war crimes have been committed. However, the most recent war (2023) was marked by the perpetration of the crime of genocide in the region, in addition to other documented war crimes. This conflict has highlighted a stark contrast between the response of international judicial bodies, namely the International Court of Justice (ICJ) and the International Criminal Court (ICC), and the inaction of the United Nations Security Council, whose role in halting the war has been obstructed. This situation underscores the critical consequences of the war, particularly exposing the deficiencies in the Security Council’s voting system and the urgent need for its reform.
