الملخص
الملخص: إن فقه الماجريات هو اجتهاد فقهي، ينتهي بالفقيه إلى ترجيح قول ضعيف أو شاذ في المذهب المالكي، في الفتوى أو القضاء، جلبا لمصلحة أو درء لمفسدة أو مراعاة لعرف جار، وهذا الصنيع الاجتهادي جار على سنن إمام المذهب في اعتبار المصالح المرسلة، أو اعتبار العرف والعوائد، أو سد الذرائع، وقد وُلد هذا النمط الاجتهادي بالأندلس في نهايات القرن الرابع الهجري، ثم أخذ ينمو ويتطور بتطور ملابسات الزمان والمكان والإمكان، هذه الأخيرة التي لعبت الدور المحوري في نحت هذه العبقرية التشريعية لدى فقهاء المالكية الأندلسيين والمغاربة عموما، حيث أنهم أظهروا تناغما عجيبا وبديعا بين روح الشريعة -الحاكمة- ومتطلبات المكلف – المحكوم عليه- بركونهم إلى هذا الأصل الاجتهادي الرصين، ثم أخذ هذا الأصل في التوسع والانتشار ليعم جل أقطار المغرب الإسلامي في بدايات القرن الثامن الهجري، فتبناه الفقهاء المغاربة بعناية فائقة وقريحة عن الجمود مارقة، وبصيرة للتقليد الأعمى ماحقة، فضبطوا أسسه وشروطه، وحققوا مقاصده، فتوالت التواليف تترا شعرا ونثرا، فأحصوا مسائله في العبادات والمعاملات، وعدّوا معاقله في الأقطار والأمصار، وحبروا به دواوين الفتاوي والأقضية، بل وجعلوه درعا يواجهون بها النوازل والمستجدات و يتأبطون بها الفرقة والنزاعات. Abstract: Indeed the jurisprudence of the applicable is a diligence that lead the jurispredent to apply a weak or an anomaly speach in almaliki school , in the fatwa or judiciary , and this is to bring interest or ward off a harm or considering the custom of a neighbor .And this diligence is under the sun ah of imam of the Madhab considering the undisclosed interests ,or considering the traditions and or the costom of neighbor or ward off a harm .and this diligencial pattern was born in Andalus at the end of the forth century then it was developed by the deference of time and place and possibilities .this latter that played a big role in shaping this legislative genius for the jurists of Andalusian and Maliki jurists and western jurists in general .in which they have shown an amazing harmony between the spirit of legislation -ruler- and the needs of the assigned _ the ruled _ by proving this deligent and sober origin .after that , this origin was spread and published all over the Islamic west by the beginning of the eighth centuryin which it was carefully adopted by the western jurists .they set its foundation and rules and they realised its aims ,so that they followed in verse and prose and they examine its issue in worship and dealing and they have got its results all over the cities , and it was a base for fatwas .it was even a shield to face all the development and new things and face all the conflicts and discriminations.
