Criminalization And Punishment Policy For Environmental Violations In Algerian Legislation

Abstract
لا شك أن البيئة تعد عاملا أساسيا يؤثر تأثيرا مباشرا في حياة الإنسان من كل جوانبها، فإذا صلحت صلحت أموره، وإذا تضررت انعكس ذلك بآثارها سلبا عليه إلى درجة التهديد بوجوده ككائن حي إلى جانب بقية الكائنات، فالمسألة مسألة وجود بالدرجة الأولى، لذلك فهي تلقى اهتماما كبيرا ومتزايدا على الصعيدين الدولي والوطني، إذ أن التحدي القائم بين التطور اللا محدود في كل ميادينه -على الخصوص في الاقتصاد القائم على الصناعة- وبين مؤثراته السلبية على البيئة التي تعد وعاء تمارس فيه المجتمعات حياتها، فمصير هذه الأخيرة مرتبط بما ستصير إليه الأولى. من هنا تبرز أهمية موضوع حماية البيئة، بمواجهة كل فعل من شأنه أن يلوثها، سواء كان مقصودا أم لا، عن وعي أو جهل، وسواء كان مرتكبه شخص طبيعي أو معنوي، إلى حد تبني المجتمعات مبدأ حماية البيئة في دساتيرها، إذ أصبح الحق في بيئة سليمة حقا دستوريا يعلو العديد من الحقوق، ليكرس بسن نصوص تشريعية عديدة منها وأهمها العقابية. directly impacts human life in all its aspects. But if it is damaged, its effects are negatively impacted, to the point of threatening the very existence of the environment as a living being alongside other creatures. Therefore, it receives significant and growing attention at both the international and national levels. Hence, the importance of environmental protection emerges in confronting any act that could pollute it, whether intentional or unintentional, conscious or unconscious, and whether the perpetrator is a natural or legal person. This has led societies to adopt the principle of environmental protection in their constitutions. The right to a healthy environment has become a constitutional right that transcends many other rights. This right is enshrined in specific texts that include criminal and punitive rules to confront various acts of environmental aggression by criminalizing and imposing penalties on perpetrators, achieving general and specific deterrence.
