الوثائق الأساسية إبان الثورة التحريرية الجزائرية

الملخص
تهدف هذه الدراسة إلى التطرق لأهم النصوص الأساسية للثورة التحريرية الجزائرية من وجهة نظر قانونية دستورية خالصة بعيدا عن كل التجاذبات السياسية والإيديولوجية، ومحاولة منا إلقاء الضوء على أهم ما احتوته من مبادئ وكذلك من حيث مكانتها المعيارية مقارنة بالدستور، وقد توصلنا من خلال تحليلنا إياها أنها تفتقد إلى عناصر الدستور على الأقل من الناحية الشكلية وإن كانت تتفق معه من الناحية الموضوعية خصوصا في بعض المبادئ السامية مثل مبدأ "الدولة الجزائرية الديمقراطية والاجتماعية ذات السيادة ضمن إطار المبادئ الإسلامية"، كما رأينا هذه النصوص رغم أنها لا تمثل دستور من الناحية الشكلية، إلا أنها حصلت على إجماع وتقبل الشعب الجزائري لها – بما فيهم السياسيين- واعتبارها خريطة طريق ساهمت في تنظيم مراحل الثورة إلى غاية الاستقلال. Abstract: This study aims to present the main fundamental texts of the Algerian revolution towards independence from point of view of their constitutionality away from the ideological political effects and it attempts to shed light on the most important principles it included, as well as in terms of its normative status compared to the constitution. Through our analysis, we have deduced that missing elements can be found in their constitutionality in relation to their forms, although they agree on the substance, especially on some higher principles such as "the principle of construction of the sovereign, democratic and social Algerian state within the framework of Islamic principles" a we demonstrate that although these texts cannot be considered as constitution in a formal sense, they are constituted on the basis of a consensus accepted by the Algerian people as the only road that contributing to organizing the stages of the revolution until independence.
