كيفية التعاقد مع القاصر المميز في عقد الإشهار

الملخص

يعتبر قاصرا في القانون الوضعي الجزائري كل فرد لم يبلغ سن الرشد وهي تسعة عشر سنة كاملة، كما أن القاصر نوعين القاصر المميز، وقاصر غير المميز، غير أننا نخص بالدراسة في هذا المقال النوع الأول، من حيث تبيين الإطار المفاهيمي للعلاقة التعاقدية التي تربط القاصر المميز بمن يتعاقد معه في عقد الإشهار، والبحث في الجوانب القانونية المتحكمة في النيابة كطريقة في تعاقد القاصر المميز في عقد الإشهار. Abstract: A minor is considered in Algerian positive law to be any individual who has not reached the age of majority, which is nineteen years, and there are two types of minors: the discerning minor and the non-discerning minor. However, in this article, we will study the first type, in terms of clarifying the conceptual framework of the contractual relationship that links the discerning minor to the person with whom he contracts in the advertising contract, and researching the legal aspects controlling representation as a method in the discerning minor's contracting in the advertising contract.
