The issue of consumer protection is a significant public concern that has received considerable attention from the Algerian legislature, particularly with the opening of avenues for investment and trade freedom. The principle of freedom of industry and commerce was constitutionally enshrined within the Algerian legal framework, notably in Article 37 of the 1996 Constitution. The 2016 Constitution subsequently reformulated and renamed this principle the freedom of investment and trade, which promotes prosperity, competition, and the prevention of monopolies. The rationale for consumer protection arises from the consumer’s position as the weaker party in such relationships. On the one hand, investors are granted privileges that positively contribute to diversifying services and meeting consumers’ needs. On the other hand, economic liberalization poses risks that threaten the safety and security of consumers.
