تكريس حق الطفل في الجنسية (دراسة في القانون الجزائري) Consecrating The Child's Right To Nationality (a Study In Algerian Law)

الملخص
ملخص للتشريعات جنوح واضح نحو حماية الطرف الضعيف؛ ففي عقد العمل يميل القانون لحماية العامل، وفي عقود الإذعان يحمي القانون الطرف المذعن دائنا كان أم مدينا، وفي فك الرابطة الزوجية يحمي القانون الأطفال آخذا في الاعتبار ضعف مركزهم في تلك العلاقة .... إلخ. وبالنظر إلى أهمية الجنسية في حياة الأفراد؛ نبحث من خلال هذه الدراسة مظاهر تكريس حق الطفل في الجنسية – أصلية أو مكتسبة- في القانون الجزائري؛ فهو بلا أدنى شك ذو مركز ضعيف وجدير بالحماية. Summary Legislation has a clear tendency towards protecting the weak party. In employment contract, the law tends to protect the worker. In contracts of submission, the law protects the submissive party, whether creditor or debtor. In breaking the marital bond, the law protects children, taking into account their weak position in that relationship.... Etc. Given the importance of nationality in individuals' lives, this study examines the manifestations of the enshrinement of the child's right to nationality – original or acquired - in Algerian law, as he undoubtedly holds a weak position and deserves protection
