الملخص
يتناول هذا المقال التحول الجذري في التشريع الجزائري بموجب القانون رقم 26/01، الذي وسّع نطاق التجريد ليشمل الجنسية الأصلية بعدما كان مقتصرًا عقودًا على المكتسبة، يستعرض البحث المحددات الموضوعية لهذا الإجراء الاستثنائي الغير المألوف والمتمثلة في ارتكاب أفعال تمس بالسيادة الوطنية، أو الإضرار الجسيم بمصالح الدولة، أو الانخراط في نشاطات إرهابية وتخريبية، خاصة في حالة الفرار خارج التراب الوطني، كما يحلل الدراسة النظام الإجرائي المستحدث مسلطةً الضوء على دور "اللجنة الخاصة" بوزارة العدل والضمانات القانونية المقررة، كحق الإخطار والإنذار وحظر انعدام الجنسية (إلا في حالات الخيانة العظمى)، خلص المقال إلى أن هذا التعديل يكرس مبدأ "الولاء" كركيزة لاستمرار الرابطة القانونية بين الفرد والدولة، مع التوصية بتفعيل الرقابة القضائية الصارمة لضمان التوازن بين مقتضيات الأمن القومي والحقوق الأساسية. This article examines the radical shift in Algerian legislation introduced by Law No. 26-01, which extends the scope of deprivation to original nationality, a measure previously restricted for decades to acquired citizens hi, The research explores the substantive grounds for this exceptional procedure, including acts prejudicial to national sovereignty, severe harm to state interests, or involvement in terrorist and subversive activities, particularly when the individual is fugitives abroad, Furthermore, the study analyses the newly established procedural framework, highlighting the role of the "Special Committee" at the Ministry of Justice and the legal safeguards provided, such as notification rights and the prohibition of statelessness (except in cases of high treason), The article concludes that this amendment enshrines the principle of "allegiance" as a cornerstone for maintaining the legal bond between the individual and the state, while recommending stringent judicial oversight to balance national security requirements with fundamental rights.
