الملخص
في ظل انتشار ثورة تكنولوجيا المعلومات والاتصالات ونتيجة للاستخدام السيئ لها تطورت الأساليب الإجرامية التي ساهمت في استحداث نمط من الإجرام الاقتصادي والمالي مرتبط بالتقنية الرقمية، فأصبحت الجرائم الاقتصادية والمالية في الفضاء السيبراني من أكثر القضايا التي تحرص الدولة الجزائرية على مواجهتها، إذ باتت هذه الظاهرة تشكل خطرا حقيقيا يهدد المجتمع كونها تتصف بسهولة ارتكابها، إضافة إلى تجاوزها للحدود الوطنية وانتشار شبكاتها عالميا. وتظهر أهمية الموضوع من خلال اهتمام الباحثين بدراسة الإجرام الاقتصادي والمالي السيبراني وتداعياته على الاستقرار الأمني. وتكمن أهداف البحث في تسليط الضوء على الجريمة الاقتصادية والمالية الإلكترونية نتيجة تفاقمها في البيئة الاجتماعية وازدياد آثارها الوخيمة التي انعكست على استقرار الدولة واقتصادها وأمنها، ومحاولة تبيان الطبيعة القانونية لهذه الجريمة من خلال إبراز خصوصيتها وصورها والأركان الواجب توافرها لقيامها. تعالج هذه الورقة البحثية مدخل مفاهيمي للجريمة الاقتصادية والمالية الالكترونية، إلى جانب دراسة أركان هذه الجريمة والتي تعد الجزء الأهم في تحديد طبيعتها، إذ أن تخلف أي ركن يؤدي إلى انتفائها. Abstract: With the spread of the information and communication technology revolution, and as a result of its misuse, criminal methods have evolved and contributed to the emergence of a form of economic and financial criminality linked to digital technology. Economic and financial crimes in cyberspace have thus become among the most pressing issues that the Algerian state seeks to confront, as this phenomenon now poses a genuine threat to society due to the ease with which such crimes are committed, as well as their transnational nature and the global expansion of the networks that perpetrate them. The importance of this topic is reflected in researchers’ growing interest in the study of cyber economic and financial criminality and its repercussions for security and stability. The research aims to shed light on electronic economic and financial crime in light of its worsening spread in the social environment and the increasingly severe consequences it has for the stability of the state, its economy, and its security. It also seeks to clarify the legal nature of this crime by highlighting its specific features, its main forms, and the constitutive elements required for its establishment. This paper presents a conceptual introduction to electronic economic and financial crime, in addition to examining the elements of this offence, which .constitute the most crucial part in determining its legal nature, since the absence of any element leads to the non-existence of the crime
