? When Artificial Intelligence (ai) Penetrates Public Procurement Contracts: Major Advantages Or Adverse Impacts

Abstract
Abstract : The progressive integration of Artificial Intelligence (AI) into our daily lives has profoundly transformed the world, raising numerous questions, particularly in the fields of public administration, economics, business organization, ethics, as well as public investment and procurement. Like all Sectors that have undergone major technological shifts, public procurement has not been immune to this technological revolution. At first glance, the impacts of (AI) on public procurement contracts align with two main hypotheses: major advantages or adverse effects, potentially present at every stage of the public deal process and implementation of the deal. Accordingly, this article aims to examine the legal issues inherently linked to the introduction of (AI) into the public procurement process. Examples include: the ethics of artificial intelligence, responsibility and risks involved. Keywords: Public procurement, Artificial Intelligence (AI), Risk, (AI) Ethics, Responsibility. الملخص: إن الاكتساح التدريجي للذكاء الاصطناعي في حياتنا اليومية ليس مجرد وسيلة لرفع جودة الحياة فقط، بل تثير هذه التكنولوجيا من حيث تطبيقاتها العديد من التساؤلات، لاسيما في مجال الإدارة الاقتصاد وتنظيم الأعمال، بل حتى مجال الاستثمارات العمومية والصفقات العموميّة . نذكر منها على سبيل المثال: أخلاقيات الذكاء الاصطناعي، المسؤولية و المخاطر المترتبة عنها، مدى توافق هذه التكنولوجيا مع المبادئ القانونية التي يخضع لها ابرام الصّفقة العمومية. من المتفق عليه، أن تأثيرات الذكاء الاصطناعي على عقود الصفقات العمومية لن تخرج عن إحدى الفرضيتين مزايا وإيجابيات أو سلبيات وعيوب، والتي من المحتمل أن تكمن في جميع مراحل تكوين الصفقة و تنفيذها. لذلك، يهدف هذا المقال إلى مناقشة المسائل القانونية المرتبطة ارتباطا وثيقا بإدخال الذكاء الاصطناعي في الصفقات العمومية. الكلمات المفتاحية: صفقات عمومية، ذكاء اصطناعي، مخاطر، أخلاقيات الذكاء الاصطناعي، مسؤولية.L’arrivée progressive de l’intelligence artificielle (IA) au cœur de notre quotidien à bouleverser le monde, ce qui soulève de très nombreuses questions, notamment dans le domaine de l’administration, de l’économie, de l’organisation des entreprises, de l’éthique, ou encore sur les investissements et l’achat publics. Au même titre que les autres domaines qui ont connus des mutations technologiques, le sujet des marchés publics n’a pas pu échapper à cette révolution technologique. De prime à bord, les impacts de l’IA sur les contrats des marchés publics ne s’écarteront pas de l'une des deux hypothèses : Avantages majeurs ou adverses, qui en effet, résident potentiellement dans toutes les phases de la l’achat public. Par conséquent, le présent article vise à discuter les questions de droit intimement liées à l’introduction de l’IA dans le processus d’achat public.
