حق غير المسلم على المسلم

الملخص
يتناول هذا البحث الحديث عن أحكام مهمّـة متعلّقـة بتعامل المسلم مع غير المسلم، مع العلم أنّ غير المسلم أصناف متنوّعـة فمنهم الحربيّ ومنهم الذمّي ومنهم المُعاهَـد ومنهم المستأمن، ولكلّ واحد منهم أحكام تخصّـه وتخصّ المسلم في تعامله معـه، لذا جاء هذا البحث ليجلّيَ أصناف غير المسلم ويوضّح الحقّ المتعلّق بكلّ واحد منهم، والغرض من هذا بيان تمام عدل الاسلام والردّ على من يحاولون تشويه صورته. وقد انطلق هذا البحث بإشكالية تدور حول بيان حقوق غير المسلم على المسلم وهذا يدفع إلى تساؤلات جزئيّة عديدة موضّحـة في المقدّمـة. وكان الهدف الأساس من هذا البحث هو البحث عمّا جاء في النصوص الشرعية وكذا في أقوال العلماء أرباب المذاهب وغيرهم في هذه المسألة وتجليتها. وقد اعتمد الباحث في الدراسة على ثلاثة مناهج رئيسية وهي المنهج الاستقرائي و المنهج التحليلي و المنهج المقارن. ولتحقيق الأهداف المرجوّة سار الباحث وفق المنهجية المتبعة في مثل هذه البحوث . كما اهتمّ بتوثيق النقولات وعزو الآيات وتخريج الأحاديث وغير ذلك ممّا هو مقرّر في البحوث العلمية. The primary aim of this study is to clarify these categories and explain the rights and duties associated with each, thereby highlighting the justice of Islam and responding to those who attempt to distort its image. The research begins with a central question: What are the rights of non-Muslims over Muslims? This overarching question branches into several sub-questions that are addressed in the introduction. The main objective of the study is to explore what has been established in the Islamic sources—Qur'an and Sunnah—as well as in the opinions of scholars from various schools of thought, in order to present a comprehensive view of this matter. The researcher adopted three primary methodologies: the inductive method, the analytical method, and the comparative method. The study follows the academic approach typical of scholarly research, with careful documentation of sources, proper referencing of Qur'anic verses, and authentication of Prophetic traditions (hadiths), among other scholarly standards.
