أزمة السياسة الجنائية في مجال الاستثمار

الملخص
تواجه السياسة الجنائية للاستثمار في الجزائر تحديات قانونية واقتصادية معقدة أثرت سلبًا على مناخ الأعمال خصوصًا مع الاعتماد الكبير على قطاع المحروقات، أين كشفت تقلبات أسعار النفط منذ جائحة كوفيد-19 عن هشاشة هذا النموذج وأكدت الحاجة الملحة لتنويع مصادر الدخل الوطني، وقد استجابت السلطات المخولة بإصلاحات قانونية أبرزها المرسوم التنفيذي 22-297، قصد تسهيل الاستثمار وتبسيط الإجراءات وتحفيز المستثمرين، ومع ذلك لا تزال جرائم اقتصادية مثل التهرب الضريبي والغش التجاري تمثل تحديًا كبيرًا يتطلب سياسة جنائية أكثر كفاءة وتوازنًا، ومنه بات تحديث الإطار القانوني والجنائي ضرورة لتحقيق بيئة استثمارية آمنة تعتمد الشفافية وتواكب التغيرات الاقتصادية، وفق تصور يعكس أهمية التوفيق بين حماية النظام الاقتصادي وتشجيع الاستثمار المستدام وصيانة الحقوق الاقتصادية للجميع. Abstract: Algeria’s criminal policy regarding investment faces complex legal and economic challenges that have adversely impacted the business climate, particularly due to heavy reliance on the hydrocarbons sector. The fluctuations in oil prices since the onset of the COVID-19 pandemic have exposed the fragility of this model and underscored the urgent need to diversify national sources of income. In response, the competent authorities have introduced legal reforms, most notably Executive Decree 22-297, aimed at facilitating investment, simplifying procedures, and incentivizing investors. Nevertheless, economic crimes such as tax evasion and commercial fraud remain significant challenges, necessitating a more efficient and balanced criminal policy. Consequently, updating the legal and criminal framework has become imperative to establish a secure investment environment founded on transparency and in step with economic transformations. This approach embodies the importance of harmonizing the protection of the economic system with the promotion of sustainable investment and the safeguarding of economic rights for all.
