الضمانات الدولية لمواجهة جريمة التهجير القسري

الملخص
تعتبر جريمة التهجير القسري من أخطر الانتهاكات التي تطال حقوق الإنسان، لاسيما تلك الجرائم التي بتعرض لها المدنيون في سياق النزاعات المسلحة على اختلاف أشكالها، هذا التهجير فقد يتم إما بصورة مباشرة كما هو الحال في الاحتلال، أو بطريق غير مباشر وذلك من خلال ارتكاب انتهاكات جسيمة في حق المدنيين الأبرياء العزل كجرائم القتل الجماعي أو القصف المستمر لمكان تجمعهم،أو الترويع مما يضطروا إلى الفرار حفاظا على حياتهم ونظرا لما تخلفه هذه الجريمة الخطيرة من تداعيات وأثار إنسانية واجتماعية وحتى أمنية البالغة الخطورة فقد أدرجت ضمن الجرائم ضد الإنسانية وفقا لأحكام القانون الدولي لما يشكله من تهديد خطير للكرامة البشرية وللسلم والأمن الدوليين. Forced displacement is considered one of the most serious human rights violations, particularly those committed against civilians in the context of armed conflicts of various forms. This displacement can occur either directly, as in the case of occupation, or indirectly through the commission of grave violations against innocent, defenseless civilians, such as mass killings, the continuous bombardment of their gathering places, or the intimidation of civilians, forcing them to flee in order to preserve their lives. Given the extremely serious humanitarian, social, and even security repercussions and impacts of this serious crime, it has been included among the crimes against humanity under the provisions of international law, as it poses a grave threat to human dignity and international peace and security.
