الملخص
الملخص باللغة العربية: تعمل كافة الدول و المجتمعات من أجل توفير حياة آمنة لأفرادها داخل المجتمع، ولعل ومن بين الأخطار التي تهدد الأمن هو ما تحدثه الجريمة بمختلف أشكالها و أنواعها، فالظاهرة الإجرامية تهدد أمن الفرد و استقرار المجتمع ومختلف مؤسساته ، ويصل أحيانا إلى تقويض أسس المجتمع وإضعاف الدول ، لهذا جاءت الشرائع السماوية ومختلف القوانين الوضعية إلى ضبط و ترشيد السلوكيات لحماية الأفراد والمجتمع على حد سواء من مختلف الظواهر الإجرامية. تعتبر الدراسات والأبحاث حول الجريمة والسلوك المنحرف من بين أهم الحقول المعرفية التي تهتم بها العلوم الإجتماعية والقانونية للوصول إلى حلول عملية علمية تساعد او تعمل على الحد من السلوك الإجرامي المنحرف .حيث نجد المشرع يسن ويقر قوانين من اجل التوصل إلى أفضل الحلول والمناهج لمواجهة الظاهرة الإجرامية في المهد، قبل تفشيها و إتباع سبل الوقاية منها، ومن أبرزها ظاهرة خطاب الكراهية والدعوة إلى التمييز حيث تعد ظاهرة مرضية خطيرة تفشت في المجتمع مع التطور التكنولوجي والمعلوماتي، والاستعمال الهائل لمواقع التواصل الاجتماعي، وما ينجر عن هذا العديد من المخالفات، والجرائم التي ترتكب عن طريق استعمال هذه المواقع ،لهذا اعتنى المشرع بهذه الظاهرة، فجاء وأقر مجموعة من الآليات و الميكانيزمات للوقاية و الحد من خطاب الكراهية والدعوة إلى التمييز ومكافحتهما Abstract: All states and societies strive to provide a safe life for their members. Among the most serious threats to security is the rise of crime in its various forms and manifestations. Criminal phenomena endanger both the individual’s security and the stability of society and its institutions, sometimes even undermining the very foundations of the state. For this reason, divine legislations as well as positive laws have sought to regulate and rationalize behaviors in order to protect individuals and society alike from criminal phenomena. Studies and research on crime and deviant behavior constitute one of the most significant fields of inquiry in the social and legal sciences, aiming to develop practical and scientific solutions to reduce criminal and deviant conduct. Legislators, in turn, enact and adopt laws to establish effective mechanisms for addressing criminality at its roots, seeking to prevent its spread and promote methods of prevention. Among the most pressing issues in this regard are hate speech and incitement to discrimination, which have emerged as dangerous social pathologies. These phenomena have proliferated alongside technological and informational advances, particularly with the massive use of social media platforms, resulting in numerous violations and crimes committed through these channels. Consequently, the legislator has given considerable attention to this issue by adopting a range of mechanisms and legal frameworks to prevent, combat, and mitigate hate speech and discriminatory practices.
