إهمال الاستئذان وضرره على الأسرة في ضوء مقصد الحياء

الملخص
يهدف هذا البحث إلى بيان موضوع إهمال الاستئذان وأثره على الأسرة في ضوء مقصد الحياء، وذلك من خلال التعرف على حقيقة الاستئذان وآدابه، وأحكامه ومقاصدها الشرعية، ثم معرفة إلى أي حد يهدد إهمال الاستئذان مقاصد الحياء واستقرار الاسرة؛ وعليه تم تقسيم البحث إلى مبحثين اثنين؛ المبحث الأول تناولت فيه الاستئذان في الأسرة وصلته بمقصد الحياء، والمبحث الثاني تطرقت فيه إلى مظاهر إهمال الاستئذان وآثاره في الحياة الأسرية، وختمته بنتائج من أهمها أن الحياء مقصد للشارع في تشريع الاستئذان، وأن إهمال الاستئذان في الحياة الأسرية إهمال للتحصينات الأخلاقية التي وضعتها الشريعة كوسائل للوقاية من الضرر بشقيه المادي والمعنوي. This research aims to address the issue of neglecting to ask permission and its impact on the family in light of the purpose of modesty. By identifying the fact of asking permission, its etiquette and its Sharia objectives. Then knowing to how far neglecting to ask permission threatens the purposes of modesty and family stability?. Accordingly, the research is divided into two sections : the first section addresses asking permission within the family and its connection to the purpose of modesty. The second section addresses the manifestations of neglecting permission and its effects on family life. The research concludes with findings, the most important of which is that modesty is an objective of the Shari'a in legislating permission, and that neglecting permission in family life is a Neglecting the moral fortifications established by Sharia as means of preventing both material and moral harm.
