أهميّة اعتبار فقه الواقع في الاجتهاد التّــنـزيليّ- فتاوى الشّاطبيّ أنموذجًا

الملخص
يتناول هذا المقال بيان أهميّة اعتبار فقه الواقع في الاجتهاد التّنزيليّ، معتمدا في ذلك أنموذج الإمام الشّاطبي من خلال فتاويه، والذّي كان عند تنزيله للأحكام مُدركًا للواقع، ومُعتبرًا في نوازل عصرِه لحال المستفتي ومآله. وقد قسّمت المقال إلى مبحثين: الأوّل منهما يختصّ ببيان حقيقة فقه الواقع والاجتهاد التّنزيليّ، وآخرهـما يهتمّ بـتجليـة اعــتـبـار فـقه الـواقع في فتاوى الشّاطبيّ، وخـتمت الـمقال بـخـاتـمة ضمّنـتـهـا جـملـة من الـنّـتـائج وبـعض التّوصيات. This article explains the importance of considering the jurisprudence of reality in the descending diligence depending on the model of imam shatby through his fatwas, who was aware of reality and considered in the dilemmas of his time the condition of the seeker of advice and his destiny. The article was divided into topics: The first is concerned with explaining the truth of the jurisprudence of reality and the dedication of the interpretation. The second is accused of showing the consideration of the jurisprudence of reality in the fatwas of Al-Shatibi In conclusion, there is a set of findings and recommendations.
