الملخص
لقد أثبتت الإدارة المكلفة بتسيير القطاع الوقفي الجزائري محدوديتها في الإشراف على إدارة القطاع لأسباب موضوعية خارجة عن نطاقها في غياب تشريعات تُنَمْذِج لمأسسة العمل الوقفي طبقا للتصنيف القانوني الحديث، الأمر الذي دفع السلطات العمومية إلى ضرورة إرساء معالم بناء مؤسسي بديل لإدارة الأملاك الوقفية بالكفاءة المطلوبة التي تفرضها أولويات العمل التنموي المنتج للثروة بالمعايير الدولية في وقت أصبح فيه العمل الوقفي يخضع لإشراف هيئات إدارية مختصة تتمتع بالاستقلالية والشخصية القانونية وعلى درجة عالية من التأهيل المهني، وهذا ما يحاول أن يجسده مشروع الديوان الوطني للأوقاف والزكاة باعتباره الجهاز الاداري الجديد الذي تم استحداثه بموجب المرسوم التنفيذي رقم 21- 179 لتسيير قطاع الأوقاف بصيغة المؤسسة العمومية ذات الطابع الصناعي والتجاري بعدما أعيدت هيكلة القطاع على ضوء الاصلاحات الحكومية الرامية لإخضاع الادارة في المؤسسات العمومية لمبادئ التسيير العمومي الجديد، ولمّا كانت فكرة الديوان تجربة حديثة جدا في إدارة الأوقاف الجزائرية لا تزال في طور التكوين فالحكم باستقلاليتها من عدمه يبقى خاضعا لما تكشف عنه معطيات الممارسة العملية مستقبلا. الكلمات المفتاحية: الوقف، الزكاة، الديوان، التسيير العمومي، الاستقلالية. Abstract: The administration in charge of managing the Algerian endowment sector has proven its limitations in supervising the management of the sector for objective reasons beyond its scope, in the absence of legislation that models the institutionalization of endowment work in accordance with modern legal classification. This has prompted the public authorities to establish the features of an alternative institutional structure to manage endowment properties with the required efficiency imposed by the priorities of wealth-producing development work in accordance with international standards, at a time when endowment work has become subject to the supervision of specialized administrative bodies that enjoy independence and legal personality and a high degree of professional qualification. This is what the National Office of Endowments and Zakat project is trying to embody, as it is the new administrative body that was created by Executive Decree No. 21-179 to manage the endowment sector in the form of a public institution with an industrial and commercial nature, after the sector was restructured in light of government reforms aimed at subjecting management in public institutions to the principles of new public management. Since the idea of the office is a very recent experience in the management of Algerian endowments that is still in the formation phase, the ruling on its independence from Its absence remains subject to what practical data will reveal in the future.
