Judicial Oversight Of Smart Procedures In E-arbitration

Authors : Messaour Djalila .

Abstract

Abstract: This study examines the role of judicial oversight in electronic arbitration and its adaptation to the impact of technology and artificial intelligence tools on arbitration procedures. It also addresses its importance in achieving a balance between protecting the principles of party autonomy and ensuring the jurisdiction of the arbitral tribunal in procedural matters, while preserving the fundamental principles of procedural fairness. This is achieved by adopting an analytical and comparative approach to the provisions of the 1958 New York Convention and the UNCITRAL Model Law on International Commercial Arbitration. In this context, the study proposes a model “censorship test” for courts in annulling, recognizing, and enforcing arbitration awards.
