This study analyzes Algeria’s legal framework regarding freedom of expression and hate speech in elections. It highlights the constitutional guarantees under Article 54 of the 2020 Constitution and Law No. 20-05 of 2020, prohibiting hateful or discriminatory speech during campaigns. The Organic Electoral Law complements these protections by ensuring media fairness and voter access to unbiased information. Institutions such as the Independent National Electoral Authority (ANIE), the judiciary, and the National Observatory for the Prevention of Discrimination and Hate Speech, along with an active civil society, enforce and monitor these rules. Challenges include ambiguous legal definitions and enforcement bias. Recommendations call for clearer laws, stronger safeguards, better training, civic education, and more transparency to uphold voters’ freedom and election integrity.
