التـدابيـر المستـحـدثة لضـمان الحـق في الـنفقة وفـقا لأحـكام الـقانون رقم 24-01.

الملخص
الملخص: نظرا لبروز جملة مـن الاختلالات في تطبيق القانون رقم 15-01 المتضمن إنشاء صندوق النفقة، والتي حالت دون تحقـيق الهدف المرجو منه، قام المشـرع بإلغائه بموجب القانون رقم 24-01 المتضمن تدابير خاصة للحصول على النفقة، والذي جاء بتدابير جديدة، ضمانا للحق في النفقة، تتمثل في تكفل الدولة، بدفع المستحقات المالية، لصالح الأشخاص الدائنين بها، من خلال صندوق النفقة، الذي يسيره وزير العدل حافظ الأختام، عن طريق الأمين العام بكل مجلس قضائي، وذلك في حالات معينة، وباتباع جملة من الإجراءات القانونية. لذلك فإن الهدف من هذه الدراسة يكمن في تسليط الضوء على مختلف تلك التدابير المستحدثة، بموجب هذا القانون ضمانا لحق الأشخاص الدائنين في النفقة. وفي الأخير تم التوصل إلى أن المشرع قد وفق إلى حد ما في تكريس تلك التدابير، ضمانا لذلك الحق، رغم وجود بعض النقائص التي تخللتها. الكلمات المفتاحية: التدابير المستحدثة، الحق في النفقة، المستحقات المالية، الأشخاص الدائنين بالنفقة، المدين بالنفقة. Abstract: Due to several inconsistencies in the implementation of Law No. 15-01, which provided for the establishment of the Alimony Fund and failed to achieve its intended objective, the legislator repealed it under Law No. 24-01, which introduced special measures to secure the right to alimony. These measures include new provisions guaranteeing the right to alimony, represented by the state covering financial dues for individuals entitled to alimony through the Alimony Fund, managed by the Minister of Justice via the Public Prosecutor at the Court of Appeal, under certain conditions. Consequently, a set of preventive measures was adopted to avoid breaches of legal obligations and to ensure the execution of alimony judgments within the specified time frame. Finally, it was concluded that the legislator has succeeded to some extent in reinforcing these measures to guarantee this right, despite the existence of some shortcomings that need to be addressed.
