Abstract: The physiological and psychological differences between women and men have led to the development of international rules that take into account the specific situation of incarcerated women, particularly those who are pregnant, by granting them exceptional treatment that balances their vulnerability with the requirements of justice. These standards include the United Nations Standard Minimum Rules for the Treatment of Prisoners, the Tokyo Rules on non-custodial measures, and the Bangkok Rules on the treatment of women prisoners and non-custodial measures for women offenders. The Algerian legislator has incorporated these principles into Law No. 05-04 on Prison Administration, which provides pregnant and breastfeeding women with a set of special measures both before and after incarceration.
