الملخص
ملخص: جاء القانون رقم 25/03 المتعلق بالمخدرات والمؤثرات العقلية وقمع الاستعمال والاتجار غير المشروعين بها، بأحكام جديدة غير مسبوقة في القوانين السابقة لمكافحة هذه الآفة الخطيرة التي انشرت بشكل رهيب وأخذت أبعاد أخرى، وجاء بآليات وتدابير توازن بين الوقاية والعلاج، والردع والعقاب، حيث لأول مرة تطرح فيه مفاهيم جديدة كحماية الأمن القومي، وتدرج فيه عقوبات رادعة تصل إلى حد الإعدام، ووسع من صلاحيات الشرطة القضائية والقضاء لمواجهة هذه الجريمة. الكلمات المفتاحية: المخدرات؛ المؤثرات العقلية؛ الاتجار الغير المشروع؛ القانون؛ Abstract: Law No. 03/25 on narcotic drugs and psychotropic substances, and on the suppression of their illicit use and trafficking, represents a significant legislative development in Algeria’s legal framework. Unlike previous laws, it introduces unprecedented provisions to confront the alarming spread of this phenomenon, which has taken on increasingly complex dimensions The law establishes a set of measures and strategies designed to achieve a balance between prevention, treatment, deterrence,and punishment. Notably, for the first time, it incorporates new concepts such as the protection of national security, provides for highly dissuasive sanctions that may reach the death penalty, and expends the prerogatives of both the judicial police and the judiciary in addressing such crimes.
