الملخص
الملخص تعتبر عملية نقل وزراعة الأعضاء البشرية مسألة كانت ولا تزال محل تساؤل واستنطاق لما تثيره من إشكالات وتأزمات نتيجة للضوابط القانونية والشرعية التي تضبط مدى فاعلية مثل هكذا مسائل، إذ أضحت في الآونة الراهنة خصوصا موضوعا للنقاش مطروحا للبحث والدراسة، فهناك من رأى أن عملية نقل وزراعة الأعضاء البشرية جائزة ومباحة قانونا وشرعا، وهناك من رفض المسألة رفضا قاطعا، وعليه إلى أي مدى يمكننا الحديث عن تطبيق عملية نقل وزراعة الأعضاء البشرية في ظل العوائق القانونية والهواجس الدينية؟ وما مدى نجاح هكذا عمليات في ظل وجاهة هذه الضوابط؟ ومن خلال هذه الدراسة توصلنا إلى أنه من باب الإنسانية أن نحاول تخفيف العوائق لبعث الأمل في نفسية المرضى ولإنقاذ حياة الإنسان. الكلمات المفتاحية: البيوتكنولوجية، زراعة الأعضاء، القانون، الدين. Abstract The process of transferring and transplanting human organs is an issue that was and still is questionable because of the problems and crises it raises as a result of the legal and Sharia controls that control the effectiveness of such issues. As it has become, especially in the present time, a topic of discussion for research and study, there are those who saw that the process of transferring and transplanting human organs is permissible and legally permissible, and there are those who rejected the issue categorically, and therefore to what extent can we talk about the application of the process of transferring and transplanting human organs in light of legal obstacles And religious obsessions? What is the extent of the success of such operations in light of the prestige of these controls? Through this study, we concluded that it is a matter of humanity to try to reduce the obstacles in order to inspire hope in the psyche of patients and to save human life.
